In opinion to City Councilman Bradshaw Smith, city attorney Thomas M. Utterback has recommended that Smith resign from council in order to serve as Cape Girardeau County prosecutor; Smith had sought advice on matter after he was nominated by Cape Girardeau County Republican Central Committee to fill prosecutor's position which becomes vacant Jan. 1.
Over objection at public hearing of number of property owners in area, City Council votes 4-1 to rezone 15.6 acres on Sprigg street in order that developers might construct apartment buildings; decision, with Mayor Howard C. Tooke casting only negative vote, clears way for West Side Development Co. to abandon its plan for condominium units in area it named Village on the Green.

Weather outdid experts last night, as temperature dropped to five degrees below predicted low of 15 in Cape Girardeau, and snow and sleet which harassed other parts of state failed to put in scheduled appearance here.
