A Cape Girardeau woman recently involved in an alleged fight at Arena Park will have a preliminary hearing Nov. 10.
Dana Fleming, 36, of Cape Girardeau is charged with unlawful use of a weapon and third-degree domestic assault stemming from an incident Oct. 3.
Fleming, her estranged husband, Lawrence Fleming, and her boyfriend, Mark Rigdon, were engaged in a scuffle at the park at East Rodney Drive and Hawthorne Road, according to a police report.
Two witnesses said Dana Fleming jumped onto Lawrence Fleming's back and attempted to choke him as he was holding down Rigdon, the report stated. They said Dana Fleming grabbed Lawrence Fleming's Glock 19 handgun and pointed it at his back.
A male witness said he took the firearm from her. Dana Fleming told an officer she wanted to disarm Lawrence Fleming because she thought he would kill Rigdon, then she immediately handed it to one of the witnesses.
The bond condition in the case was amended Oct. 16 to allow the Flemings to have contact regarding their children. Dana Fleming posted a surety bond equivalent to $20,000 on Oct. 4.
