Special prosecutor named to look into Poplar Bluff nepotism allegations

POPLAR BLUFF, Mo. -- A special prosecutor was appointed Wednesday to investigate accusations of nepotism against Poplar Bluff City Council member Jack Rushin.

Ripley County assistant prosecuting attorney Kasey Proctor was named to handle the case in a court order signed by Presiding Judge Michael Pritchett.

"My job is essentially going to be further investigation," Proctor said Wednesday. "At this point, it's in the investigation stage."

Proctor said he could not comment further on the matter during the investigation.

Butler County Prosecuting Attorney Kevin Barbour asked for a special prosecutor to be appointed for investigation and prosecution of possible ethical and propriety issues, according to court documents.

Rushin has been accused of violating state law by voting to name his first cousin, Greg West, to the city hall feasibility study committee.

The law forbids a public officer from appointing a relative of the fourth degree to any public office, including voluntary positions, Poplar Bluff lawyer John Scott said in letters issued April 20.

Scott, who represents an unnamed Poplar Bluff citizen, called for Rushin's voluntary resignation.

Rushin refused to resign and later said he did not feel it was wrong to vote on the appointments because the city hall committee was a temporary advisory group.

The matter will have to be decided by a judicial authority, Rushin said at the time.
