Senate gives initial approval to changes in rape measure

JEFFERSON CITY, Mo. -- Rape victims would need documentation of an attack around the time it occurred in order for their cases to be prosecuted years later, according to a Senate bill revised Wednesday.

The legislation would give prosecutors unlimited time to file charges in rape and sodomy cases. But under a provision added in the Senate, a victim would need a formal legal complaint, hospital evidence or other documentation within three years of the rape in order for prosecutors to file charges later.

The Senate endorsed the bill by voice vote Wednesday but must take a roll call vote -- perhaps later this week -- before the legislation can go to the House. Representatives on Tuesday voted 132-0 to send their version to the Senate. It contains no conditions for filing changes.

The proposals are legislators' response to a ruling two years ago by the Missouri Court of Appeals' Western District that interpreted state law as imposing a three-year statute of limitations on rape and sodomy.

Bill supporters say changes in DNA technology allow investigators to solve crimes years after they happen.

Sen. David Klarich said there appears to be an agreement the Senate's measure will be acceptable in both chambers. He is chairman of the Senate Judiciary Committee, which will hear the House bill and plans to change it to mirror the Senate proposal.
