DONIPHAN, Mo. -- Western District Commissioner Jerry Halley, who was defeated in the Nov. 6 general election by three votes, filed a petition for a recount in Ripley County Circuit Court on Wednesday.

Halley, a Democrat, received 1,265 votes while Republican Johnny Taylor Jr. tallied 1,268 votes.

The petition indicates any candidate defeated by less than 1 percent of the votes cast for the office has the right to a recount.

Halley is requesting a judge enter an order to have all ballots cast for Western District commissioner recounted. He is being represented by attorney Dale Nunnery of Doniphan.

A hearing before Associate Circuit Judge Thomas Swindle was scheduled for 9 a.m. Wednesday in Ripley County Circuit Court. At that time, a date for the recount will be set.
