A Cape Girardeau man opened his apartment door about 7:45 a.m. Friday to find a 31-year-old man standing just outside, police said. He did not have a chance to ask the man what he wanted before he was pushed back into his apartment, grabbed by his shirt and punched in the side of his face, police said.

Cape Girardeau police on Friday arrested Ryan Scott Mosley, 31, of Cape Girardeau.

The Cape Girardeau County Prosecuting Attorney’s office charged Mosley with first-degree burglary and third-degree assault. Mosley’s bond was set at $50,000 cash or surety.

Mosley struggled with the victim inside the apartment and knocked over a lamp, according to a probable-cause statement filed in the case by Cape Girardeau police officer David Weidenbenner.

While they were inside, a neighbor yelled he was going to call the police, prompting Mosley to leave. He left in a blue Ford Focus without license plates, Weidenbenner wrote.

Weidenbenner wrote he saw the victim bleeding out of his left ear, and the victim said his hearing was muffled.

The neighbor who called police told the same story as the victim: Mosley pushed his way inside after the victim opened the door, and a struggle ensued, Weidenbenner wrote.

As Weidenbenner talked to another neighbor, a female driver parked the Focus in a lot next to the building.

Weidenbenner spoke with the driver, according to the statement.

She said the alleged assailant asked her to drive to the Townhouse Inn, Weidenbenner wrote.

Mosley was arrested about 9 a.m. at the Townhouse Inn, according to the statement.

After Mosley was read his Miranda rights, he said he was on the porch of the second floor of 51 Hazel St. about 7:45 a.m., Weidenbenner wrote.

He said he began pacing when he saw the door open, and the victim “came at him,” according to the statement.

He said he also thought the victim was mad at him about something, and he said he did not take anything from the apartment.
