According to Kenneth E. Vowels, county executive director, Scott County Farm service Agency, producers may take a marketing assistance loan or loan deficiency payment on harvested crops.
Eligibility for either option requires producers to make application before beneficial interest is lost in the commodity. For a producer to have beneficial interest int commodity, the producer must have control of the commodity, title to the commodity and risk of loss in the commodity.
Control means the producer must be able to make all decisions affecting the commodity without restrictions. Title to the commodity means the producer has not sold or delivered the commodity including the delivery of warehouse or bale receipts.
Producers who will be delivering the commodity directly to the buyer need to make application on a CCD-709, "Direct Loan Deficient Payment Agreement" at the local Farm Service Agency Office before the commodity is harvested. Any commodity delivered and sold prior to application is ineligible for loan deficiency payment. This applies to all grains, rice and upland cotton.
