Sgt. Larry Plunkett, a public information officer with the patrol, said Lively has had both good and bad days, "it's just a matter of stringing together the good days. At this point, he's about as well as can be expected."

Plunkett said the investigation of the accident will continue for another 15 to 20 days before information is turned over to the prosecuting attorney.

He also said the incident appears to be unintentional.
