If the Democrat isn't able to get the lawsuit by Republican Norm Coleman dismissed, a trial could start Jan. 26.

The dismissal hearing is scheduled for Wednesday.

The razor-thin Senate race between the two has Franken ahead by 225 votes after a statewide recount. Coleman's lawsuit raises issues about how the recount was conducted.

Minnesota could be short a senator until the suit is resolved. Franken has sued separately in his quest for state certification to the seat.
