Commander eviction hearing scheduled for Sept. 26

BENTON, Mo. -- A court hearing has been set in Scott County in a lawsuit filed by Cape Girardeau officials to evict Commander Premier Aircraft Corp. from city-owned property at the airport. The hearing is scheduled for Sept. 26 at 9 a.m. before Judge Scott T. Horman in Benton. The lawsuit, filed Friday, is being heard in Scott County because that's the home of the Cape Girardeau Regional Airport. The circuit clerk's office said Tuesday the Commander executives have yet to be served. The lawsuit, legally known as an unlawful detainer action, is basically asking the judge to allow Commander's eviction. The city last received a lease payment from the recently bankrupted company in December 2007 and the city is owed $1.2 million in back payments. This lawsuit does not ask for payment because the company is protected by Chapter 11, but a Texas judge recently ruled for the city that eviction proceedings could move forward.
