Commander Premier Aircraft Corp. has dropped its legal challenge to the October eviction from a city-owned hangar at the Cape Girardeau Regional Airport. "The eviction is final," city manager Scott Meyer told Cape Girardeau City Council members at its Monday meeting. The bankrupted airplane manufacturer voluntarily dismissed its appeal to the eviction Monday. The courts officially dismissed the appeal later that day. Commander filed the appeal Nov. 7, although the Scott County Circuit Court had yet to act on it. The case is still in front of the federal bankruptcy courts, with a hearing scheduled for Jan. 17 in Tyler, Texas. Earlier this month, a judge there gave Commander another month to reorganize before he will consider Cape Girardeau's motion to allow the company's assets to be liquidated. City officials want the company's bankruptcy status to be changed from Chapter 11 to Chapter 7 to recoup the more than $800,000 that court documents show the company owes city coffers from unpaid lease payments.
