Timothy Curtis Stewart was charged with endangering the lives of three children and suspicion of driving while intoxicated, by the office of the Cape Girardeau County prosecuting attorney.
Stewart, 36, of 1413 Cape Girardeau, faces up to seven years in prison or one year in the county jail for one felony count of endangering the welfare of a child, up to one year in the county jail for one misdemeanor count of driving while intoxicated and up to six months in county jail for one misdemeanor count of driving while revoked.
Stewart is being held on a $15,000 cash/surety bond.
According to the probable cause statement, Stewart was babysitting a boy and two girls, 5, 6 and 4, while his nephew and his wife were at work. The children's mother said that he was staying with the family until he could find a job.
Cape Girardeau patrolman Joshua Smith pulled Stewart over at West End Boulevard and Scott Street for driving 26 mph over the speed limit and swerving. Smith discovered the children in the vehicle.
The smell of alcohol was strong, with Stewart's eyes watery, bloodshot and glassy, according to the statement. He tested positive for alcohol during the sobriety test and was arrested.
A breath sample at the police headquarters indicated a blood-alcohol level of 0.102 percent.
