ADVANCE, Mo. -- An Advance man was in the Stoddard County Jail under a $75,000 cash-only bond Tuesday facing numerous charges following an incident that began Thursday.
Timothy Allen Delay, 32, from Advance, is charged with first-degree assault of a law enforcement officer, armed criminal action (two counts), driving without a license, leaving the scene of an accident and felony resisting arrest.
According to a statement filed by Missouri State Trooper Travis D. Templemire, Delay pulled out of a driveway on County Road 307 south of Advance at about 10:45 p.m., driving a 1952 Chevrolet two-ton dump truck. Templemire reportedly was traveling the road at the time and fell in behind the vehicle, which was southbound on County Road 307.
"The vehicle traveled off the right side of the roadway and began traveling north through a field," Templemire stated. "The vehicle then drove back onto County Road 307. I activated my patrol vehicle's emergency equipment in an attempt to stop the vehicle."
The truck failed to yield, continuing north on 307, then entered another field, turned and returned onto the roadway traveling south. As the truck rounded a curve, it traveled into the northbound lane and struck a Stoddard County deputy's patrol vehicle with its emergency equipment activated.
Once again, the truck entered a field and returned to the county road, continuing southbound.
It was at this point, Templemire stated, that the truck came toward the patrol vehicle in the northbound lane, attempting to hit the patrol car.
"I took evasive action and began backing south," Templemire said. "I then traveled off the roadway to avoid a collision."
The driver, the report stated, attempted to ram the patrol vehicle "multiple times" during the pursuit. In the process, the driver of the truck also attempted to strike the patrol vehicle of Stoddard County sheriff's deputy Justin Brooks multiple times.
Finally, after backing the truck into a fence row, the driver fled on foot. Templemire stated there were three other occupants in the vehicle. All of those occupants identified the driver as Timothy Delay.
A check revealed Delay's driving status to be suspended for alcohol consumption. He eluded police but was later arrested at his Advance residence at 125 S. Garrett St., where law enforcement was told repeatedly by Rachel Fisher, 25, at the residence that Delay was not in the house. Fisher refused a request to search the home. A phone call to Delay's own mother summoned her to the residence, and she gave permission for police to search the house. When police entered the home and called out Delay's name, he responded and was arrested without further incident.
Fisher was subsequently charged with hindering prosecution. Delay remains in the county jail under a $75,000 cash-only bond. He is scheduled to appear for arraignment before Judge Joe Z. Satterfield in Bloomfield on Thursday.
