The subdivision, off Pioneer Orchard Road in Jackson, already includes 109 lots since it was established six years ago. The next four phases were to consist of 52 lots zoned for single-family residential district and 14 lots for duplexes.

At Monday's meeting, the aldermen approved rezoning 52 lots to R-2 single-family residential district, but the 14 lots that could have been rezoned as R-3 one- and two-family residential district were instead left as R-1 single-family residential district.

John Lichtenegger, who co-owns the subdivision's developer Missouri Lakes LLC, withdrew his request April 22 to rezone the 14 lots as R-3.

Last month some homeowners in the subdivision had voiced concern about the construction of duplexes in the development. Five residents of the subdivision voiced concerns at an April 5 public hearing that the duplexes would decrease property values of homes there. And on April 19 the aldermen received a copy of a petition from 32 of the homeowners reiterating the same concerns that were raised during the public hearing.

When reached at home for comment, Lichtenegger said he was not disappointed by the board's decision.

"We'll address next year what to do with those lots that were to become duplexes," Lichtenegger said. "There are so many opportunities to move forward with properties and live in total concert and harmony with everyone."

Lichtenegger now said he will go forward with construction on the 52 single-family residential lots sometime in the future, though he does not have a planned date for construction on the homes.

The aldermen approved Construction Engineers Contracting Inc. of Ste. Genevieve, Mo., for work on the Elwanda Relief Sewer Project in the amount of $425,660.31. The project will replace existing sewer lines along Rocky Branch between West Jackson Boulevard and Strawberry Lane.

Work on the project should begin by the end of the month and be complete by the summer, said public works director Rodney Bollinger.

At the end of the meeting, re-elected aldermen took an oath of office. Four incumbents ran for re-election, and all four won on April 6. They are Ward 1 Alderman Tim Welker, Ward 2 Alderman Dave Reiminger, Ward 3 Alderman Larry Cunningham and Ward 4 Alderman Joe Bob Baker.

* Approved the rezoning of the lots in Pioneer Orchard seventh, ninth and tenth subdivisions from R-1 (single-family residential) District to R-2 (single-family residential) District, as submitted by Missouri Lakes LLC.

* Accepted the dedication of right of way, permanent easement and temporary construction easement deeds from the Michael H. Lackamp Revocable Trust Agreement and the Sandra Kay Lackamp Revocable Trust Agreement, relative to the South Old Orchard Road Improvement Project.

* Amended Chapter 21 of the city code on storm-water illicit discharge.
