Clay Waller's appeal on his federal sentence for making a threat over the Internet was deemed deficient by a case manager Thursday.
Waller's attorney, Scott Tilsen, electronically submitted the appeal Wednesday afternoon but it was flagged Thursday because Tilsen had only submitted the brief's cover page, according to a memorandum from Missouri Court of Appeals case manager Jackie Polk.
Tilsen has five days to resubmit the appeal.
Waller pleaded guilty to threatening his sister-in-law, Cheryl Brenneke, on an online message board and was sentenced to five years in a federal prison In January. Brenneke gained custody of Waller's three children after her sister, Jacque Waller, went missing June 1. Clay Waller is considered a suspect in Jacque Waller's disappearance, and Cape Girardeau County Prosecuting Attorney Morley Swingle anticipates filing a murder charge against him.
Clay Waller is currently serving his federal sentence at the Federal Correction Institution in Oakdale, La.
