The man believed responsible for a shooting on Olive Street earlier this week is scheduled to appear in court Monday.

Tommy Joe Davis III, 29, of Cape Girardeau will appear before Judge Gary Kamp for initial arraignment in Jackson at 11 a.m.

Davis was taken into custody in Illinois Wednesday afternoon. He has been charged with first-degree assault and armed criminal action on suspicion of shooting a man earlier that day at 523 Olive St. in Cape Girardeau. Judge William Syler set Davis' cash-only bond at $250,000. The victim was shot in the stomach and taken to a local hospital with what police described as a serious injury. A probable-cause statement said there was no argument between the two at the time of the shooting, but there may have been a love triangle among the victim, Davis and Davis' girlfriend.

Witnesses at the scene of the shooting directed police to Davis' home at 1314 Amblewood Drive. A police spokesman said officers arrived at the home just after 5 a.m. and detected movement inside. Believing it was Davis, officers made multiple attempts to contact him via loudspeaker and to convince him to answer his phone or come outside.

Nearly six hours later, two young men emerged from the home and revealed Davis was not there. Sgt. Jason Selzer said in an interview Wednesday that it was not immediately clear why the men did not leave the home when police first arrived at the scene or if the pair had any connection to Davis.
