Pharmacist's trial date questioned

KANSAS CITY, Mo. -- Delaying the trial of a pharmacist accused of diluting chemotherapy drugs could result in a "miscarriage of justice," federal prosecutors say.

Prosecutors on Tuesday filed court documents arguing against a defense request for a delay in Robert R. Courtney's trial.

Courtney, 48, has pleaded innocent to 20 counts of tampering, adulterating and misbranding the chemotherapy drugs Gemzar and Taxol.

A judge has set the trial date for Oct. 1, but Courtney's attorney, Jean Paul Bradshaw, has asked the date be changed to February or a "special setting." Bradshaw says he needs more time to prepare for the case.
