BLOOMFIELD, Mo. -- A Marble Hill, Mo., man arrested after pulling a gun on an Advance police officer has requested a new judge.
Scotty Hooe was arrested on Oct. 17. After his first hearing, he requested a new judge. The motion was allowed by Judge Joe Satterfield, and the case has been sent to Presiding Judge Stephen Sharp for reassignment.
No word has been given on when the new judge will be named, and no hearing date had been set.
On Oct. 17, Advance Police Chief Donnie Bohnsack received a call of a careless and imprudent driver coming into Advance on Route O. Originally unable to respond, when a second call regarding the driver came, Bohnsack left in pursuit.
When Bohnsack first spotted the vehicle, it was stopped in front of a local church. When he approached it, the vehicle sped off. As it headed north on Highway 91 from Advance, the vehicle began swerving from one side of the road to the other, according to a probable cause affidavit filed in the case.
After activating his sirens, Bohnsack followed the car to the Stoddard/Bollinger county line, where the driver stopped.
As he approached the vehicle, Bohnsack noticed an "older white male" and a border collie in the front seat. The driver, later identified as Scotty Hooe of Marble Hill, refused to move the dog when requested to do so by the officer.
When Bohnsack asked Hooe if he had been drinking, the driver responded by asking if [Bohnsack] had been drinking. Bohnsack then told Hooe to exit the vehicle, and when he opened the door, he reportedly spotted the barrel of a gun, later determined to be a .45 caliber pistol, by Hooe's right leg, with his right hand open and resting beside his leg.
Bohnsack said in the affidavit that when he tried to seize the weapon, Hooe told him he had a right to have the gun and that [Bohnsack] was not taking it. The officer then drew his own weapon and reached for the gun. Hooe then allegedly grabbed his own gun and began to raise it. At that time, Bohnsack grabbed the muzzle of the gun and forced it into the driver's seat of the car and put his own pistol against Hooe's side. Hooe still maintained his grip on the gun with his finger on the trigger the entire time while asking repeatedly for the officer to please kill him.
Bohnsack said he chose not to kill the man because he believed he could get the gun from him and because of Hooe's intoxicated state.
Bohnsack then obtained possession of the weapon and put it in his back pocket as Hooe came out of the truck. He radioed for assistance and fired his stun gun. Hooe went down on the highway and after a struggle, Bohnsack fired his stun gun again. He then flipped Hooe over, handcuffed him and removed him from the roadway so that traffic could get through.
After the situation was diffused, Bohnsack called Stoddard County dispatchers to tell them what had transpired and requested an ambulance.
Bohnsack found a one-third full bottle of whiskey on the floorboard of the vehicle Hooe was driving.
During questioning, Hooe reportedly asked Bohnsack why he hadn't killed him. He said that Hooe, despite everything, was more worried about his dog than anything else.
Hooe is charged with first-degree assault of a law enforcement officer, armed criminal action, and resisting arrest.
