A Cape Girardeau man facing charges after allegedly firing a weapon at a vehicle appeared in court Monday.
Brandon King, 28, who had been scheduled to enter a plea, online court records show, had his case continued, but only after addressing the court.
King told Judge Benjamin Lewis he didn't know how to plead because evidence used to obtain the warrant for his arrest "doesn't exist or was lost." He said a written statement or letter from the alleged victim to police had not been turned over to his attorney, Jennifer Slone.
"I feel that I'm being treated unjustly in the court right now," King said.
King is charged with unlawful use of a weapon after an incident in early April on Rodney Vista Boulevard in Cape Girardeau.
After hearing King, Lewis read from the probable-cause statement attached to the warrant that talked about an oral statement given by a witness, plus a bullet hole found in the trunk lid of the vehicle he allegedly shot at and a bullet found in the trunk.
The affadavit "clearly provides probable cause for the warrant," Lewis said, assuring King if a written statement from a witness does exist and is not brought up by the state before the trial, it will not be admissible as evidence.
Lewis continued the case to Aug. 10 at the request of Slone, who asked for time to collect depositions. No trial date has been set.
