DECATUR, Ill. -- -- A Macon County judge has ruled that a West Virginia man accused of attacking a Decatur woman and her 4-year-old daughter in January is unfit to stand trial.

Kevon P. Banks, 32, faces multiple felony counts of home invasion, sexual assault and sexual abuse.

After reviewing reports from two experts, including a psychologist who said Banks was likely schizophrenic, Macon County Circuit Judge Jerry L. Patton ruled Wednesday that Banks was unfit.

But the judge also ruled that with treatment, Banks would probably become fit to stand trial.

The ruling means that Banks, who is in custody, will receive treatment from the Illinois Department of Mental Health.

Assistant Macon County State's Attorney Scott Rueter said the department will report periodically on Banks' progress, and Banks will return to Decatur within a year for another fitness hearing.
