John Lichtenegger believes the time is right for an expansion of Pioneer Orchard subdivision.

After a lull for most of 2009 in new lots purchased in his 109-lot development in Jackson, Lichtenegger, who owns Missouri Lakes LLC with his son Brent, said business has increased once again. Since late fall about 12 lots have been sold, leaving 10 available for sale since the development off Pioneer Orchard Road was established six years ago.

"People are buying lots and building again," said Lichtenegger, who also is a partner with Lichtenegger, Weiss and Fetterhoff law firm. "Most of last year it was all on hold. But late last year and this year builders and home buyers started calling again."

Wednesday night his plans took one step closer to becoming reality when the planning and zoning commission approved the recommendation of a plat of four additional phases. The commission also approved a recommendation to rezone the phases from R-1 single-family residential to R-2 single-family residential and R-3 one- and two-family residential.

The recommendations will then be placed on the agenda for a public hearing and vote at a future board of aldermen meeting.

"It's remarkable to see how things have sort of filled up," Lichtenegger said. "Obviously we have a popular area with sidewalks and proximity to schools."

About 35 lots total would be in three of the phases, with most of the homes costing between $160,000 and $250,000. During the fourth phase about 50 lots would be created, but Lichtenegger said he is not ready to begin building homes in that phase just yet.

"I'm confident enough that I can sell those 35 lots, but I'm not ready to start building on the fourth phase," Lichtenegger said.

The commission also approved a recommendation of a special-use permit for a home-based pedicure business.

Brenda Martens of 403 Springview Drive is a registered nurse who offers pedicures to elderly people in locations throughout Southeast Missouri. Martens said she wants to offer the same service at her home without having to travel hundreds of miles.

"I go to different towns and I've seen the need," Martens said. "I know there's enough [senior citizen clientele] to offer the business around here."

Jackson city staff recommended six special conditions Martens must follow to receive the permit. Those include hours by appointment only, no advertising signs displayed and someone other than the resident of the home cannot be employed on the premises.

Commission chairwoman Mary Miller asked Martens if she could comply with the special conditions.

Martens said she had seen the conditions and would comply.
