GREENVILLE, Mo. -- Ongoing federal prosecution of a Piedmont, Mo., man accused of calling in a bomb threat at Windsor Foods led to his state charges being dismissed.
Wayne County Prosecuting Attorney Robert Ramshur reportedly dismissed the charges against Marty Allen Shriver, 27, Thursday morning because Shriver is being prosecuted federally.
Shriver had been scheduled to appear before Associate Circuit Judge Randy Schuller on the felony of making a terrorist threat and a felony of false bomb report.
Shriver, who is being detained without bond, is charged with one count of using a telephone to make a false bomb threat, according to assistant federal prosecutor Keith Sorrell.
The indictment alleges that on Nov. 5 Shriver "by means and use of an instrument of commerce ... the telephone, maliciously conveyed information knowing the same to be false, concerning an alleged attempt being made to destroy a building, Windsor Food in Piedmont by means of an explosive device."
Sorrell said Shriver was arrested Dec. 16 and was arraigned by U.S. Magistrate Judge Lewis Blanton.
Since that time, "we tried a motion to suppress evidence on March 8, 2010, again in front of Judge Blanton," Sorrell said.
Blanton, he said, has made no ruling yet "as we haven't finished briefing."
A supplemental hearing also may need to be held, but no new court date has been set, Sorrell said.
The charges stem from a telephone call, which was made about 5:45 a.m. Nov. 5 to the Wayne County Sheriff's Department indicating there were bombs at Windsor Foods in Piedmont.
