Defendant disputes details of sentencing report in robbery, assault case

A Cape Girardeau man charged in connection to a May robbery had his sentencing hearing delayed Monday after he disagreed with information in a sentencing assessment report and the details of the crime were questioned by the judge.

Ombra Dockery, 21, charged with attempted robbery, a felony, pleaded to a reduced charge in January for assaulting a man on Broadway. The victim said that Dockery, with Stephen R. Johnson, demanded he give them his belongings, including his wallet and keys. The victim suffered an injury to his eye, police wrote in an affidavit filed with the court.

Circuit Court Judge Benjamin F. Lewis said some of the robbery's details, as listed in a sentencing assessment report, were disputed by Dockery. Lewis set a sentencing hearing for March 18 so he could hear the details of the case.

With Dockery's plea agreement, the state is recommending he serve seven years.

Johnson, who pleaded guilty to second-degree robbery Jan. 18, will be sentenced Feb. 22 by Circuit Court Judge William L. Syler.
