At a preliminary hearing Tuesday, Associate Circuit Judge Gary A. Kamp upheld charges against a man charged with throwing a chemical substance in another man's face.

Marzell Davis, 49, of Cape Girardeau faces charges of first-degree assault after allegedly tossing the contents of a blue cup into the face of James J. Dennis at a Cape Girardeau residence in September.

Dennis, 44, of Mounds, Ill., lost his left eye as a result of the incident. He identified Davis in July after seeing a photo lineup.

Davis will appear for arraignment Sept. 2 before Circuit Judge William L. Syler.
