Members present were Mayor Steve Loucks and city attorney David Summers. Council members present were Darlene Crocker, Ron Davis, Jerry Childers, Robert Sullivan, Ann Whistler, Ryan Pennington, Ronnie Eichhorn and Eric Seyer.
The meeting was opened by Loucks, and the Pledge of Allegiance was led by Summers.
* Minutes of the previous meeting were read by the city clerk. Motion to approve the minutes with the correction that the typewriter and calculator are inoperable by Sullivan, seconded by Eichhorn; motion carried.
* Minutes of the special meeting were read by the city clerk. Motion to approve the minutes by Pennington, seconded by Whistler; motion carried.
* Building permits were presented for Gill Family Properties for three apartments at Main Street and the railroad crossing in the amount of $150,000 for each building and Billy Heisserer at 408 Elliott Ave. for a safe room for Chaffee Elementary School in the amount of $495,333 and Chaffee High School in the amount of $383,333 for an industrial arts room. Motion to approve the building permits by Davis, seconded by Childers; motion carried.
* Chief of police Jim Chambers advised that WatchGuard was here and went over the cameras for the police cars.
* The fire department will have an open house Oct. 18.
* Rusty Golightly advised they are organizing emergency preparedness supplies and explained what they are doing.
* The judge's report was presented for September. Motion to approve the report by Sullivan, seconded by Seyer; motion carried.
* Monthly bills were presented. Motion to pay the bills by Crocker, seconded by Childers; motion carried.
* Clerk presented the following bills for approval: Rhodes 101, public works, $1,137.50, police, $1,089.15, park, $227.35; ATT, $431.09 and Pete Tanner Solid Waste, $15,896.80. Motion to pay the bills by Pennington, second by Eichhorn; motion carried.
* Clerk presented a renewal of a special-use permit for Shirley Childers for a beauty salon at 607 W. Davidson Ave. Motion by Davis to turn over to the planning and zoning committee, seconded by Pennington; motion carried.
* Collector's report for September was presented. Motion to approve the report by Sullivan, seconded by Whistler; motion carried.
* Asked for permission to spend $800 for a computer for the chief of police due to additional data and system resources required by the police car cameras. Motion to spend up to $800 for a computer for chief of police by Pennington, seconded by Eichhorn; motion carried.
* Asked for permission to spend $600 for two smartphones for the water department. Motion to spend up to $600 by Seyer; motion carried.
* Advised the hearing with the planning and zoning committee on the special use permit at 520 W. Yoakum Ave. was Oct. 8.
* Cost of the health insurance for employees is increasing 34 percent to 50 percent and explained.
* Advised the process is moving forward on the property at 214 W. Davidson Ave.
* Advised of two class-action lawsuits by ATT, one is in connection with the bonds for the water and sewer system. Second is relating to CenturyLink estimating the city may have $638 they can recover. Council will need to adopt an ordinance if they want to proceed with recovering the $638. Motion by Seyer to proceed with ordinance, seconded by Sullivan; motion carried.
* Motion to have the first reading of an ordinance accepting an acknowledgment of being bound by the terms and conditions of the settlement agreement of CenturyLink Inc. class-action settlement in case No. 12SL-CC01723 in the circuit court of the county of St. Louis and to authorize acknowledgment of being included as a class member in said proceeding and authorizing the appropriate officials to execute such documents as may be necessary in order to effectuate the same by Seyer, seconded by Whistler; motion carried. Motion to approve the first reading by Seyer, seconded by Childers; motion carried. Motion to have the second reading by title only by Pennington, seconded by Seyer; motion carried. Motion to approve the second reading by Childers, seconded by Eichhorn; motion carried. Motion to adopt the ordinance by Seyer, seconded by Pennington; motion passed with Davis voting "no."
* Sullivan advised some residents asked who will settle the claims with Kajacs. City administrator recommended calling Kajacs. Discussion was then heard.
* Whistler advised the school is discussing the scoreboard at Harmon Field and asked if the park board would go in half on a scoreboard at a cost of $4,500 if Coca-Cola will not pay for it. The cost would be $2,250 this year and $2,225 next year. Motion by Whistler to give $2,225 to the school if Coke does not fund the scoreboard, seconded by Sullivan. This will come out of the park board budget; motion carried.
* Whistler advised next year is the 75th anniversary of the swimming pool and the park board would like to paint the swimming pool.
* Crocker asked if the city received anything on damages at the cemetery. Administrator advised that nothing has been received yet.
