Witness, Waller son face charges for fight outside preliminary hearing

Tickets will be sent to two people arrested for fighting Wednesday outside the Cape Girardeau County Courthouse in Jackson during a recess from the preliminary hearing for Clay Waller.

Jackson city attorney Tom Ludwig said a prosecution witness, Matt Marshall, and Clay Waller's son, James Clay Waller III, who goes by J.C. Waller, will each receive tickets for peace disturbance and "engaging in affray," or fighting.

Video and photographs taken of the fight show the two men throwing punches at each other and Marshall falling to the ground.

James Clay Waller III and Marshall are no longer in custody.

Ludwig said the issuance of the tickets will require court appearances, which will likely be scheduled on the Jackson municipal court's September docket.

Clay Waller is charged with first-degree murder and tampering with evidence in connection with the disappearance of his wife, Jacque Waller.
