Cape man's trial is scheduled for October
Tuesday, April 26, 2011
A judge set a Cape Girardeau man's murder trial Monday for late 2011.
Allen Walker Jr., accused in the death of his 7-week-old son, will have his case heard by a jury beginning Oct. 12.
The trial will conclude Oct. 14.
Walker was charged in August with second-degree murder and child endangerment following his son's death at a St. Louis hospital.
The child had severe injuries to his head that medical professionals told the court at Walker's preliminary hearing couldn't have been caused by a Pack-and-Play falling onto its body. Walker told authorities after his arrest the playpen fell on the infant.
Circuit Court Judge Benjamin Lewis said after the hearing Monday he wasn't sure where the jury trial would be held.
Prior to Walker submitting a motion for a new attorney, which was granted in March, a jury was going to brought to Cape Girardeau County from Scott County.
Lewis set a hearing for May 25 to discuss the trial's venue and discovery that Walker's attorney, Patty Tucka, told the court Monday they still needed to obtain from his former counsel.
