Judge's ruling in Kezer case has harsh criticism for Hulshof

COLUMBIA, Mo. (AP) -- A Southeast Missouri man convicted 15 years ago in a college student's murder may soon be set free under a judge's ruling that sharply criticizes former Rep. Kenny Hulsof, who prosecuted the case, for withholding evidence from defense attorneys.

Cole County Circuit Judge Richard Callahan ruled Tuesday that Joshua Kezer, who was 17 at the time, was wrongly convicted in the 1992 death of 19-year-old Angela Mischelle Lawless. She was found in her car on the Interstate 55 exit ramp near Benton with the motor still running.

The judge's 44-page ruling on Kezer's habeas corpus petition took issue with the courtroom conduct of Hulshof, a former special prosecutor who later served as a six-term Republican congressman from Columbia before losing the 2008 governor's race to Democrat Jay Nixon. The judge ruled that Hulshof, who traveled the state prosecuting high-profile murder cases in small towns, improperly withheld several key pieces of evidence from Kezer's defense attorneys.

"There is little about this case which recommends our criminal justice system. The system failed in the investigative and charging stage, it failed at trial, it failed at post-trial review and it failed during the appellate process," Callahan said.

Callahan ordered that Kezer -- convicted of second-degree murder and sentenced to 60 years -- be set free from the Jefferson City Correctional Center within 10 days, unless Scott County Prosecutor Paul Boyd seeks a retrial. Boyd did not immediately respond to a request for comment Tuesday.

Hulshof, who is now with a Kansas City-based law firm, issued a statement Tuesday expressing confidence in the integrity of Kezer's trial.

"Today's opinion goes to great lengths to cast doubt on the credibility of the state's witnesses," Hulshof said. "But twelve jurors looked these witnesses in the eye, dispassionately listened to their testimony, and found them to be credible. The jury came to a unanimous decision that Mr. Kezer's alibi witnesses were not credible and that the state had proven beyond a reasonable doubt that Joshua Kezer was the murderer.

"I remain confident in the jury's verdict. My biggest regret is that the family of Mischelle Lawless is experiencing a travesty of justice."

According to Callahan, the case's "only bright note" was Scott County Sheriff Rick Walter, who reopened the case in 2006. Walter had responded to the Lawless murder scene more than a decade earlier as a reserve deputy.

Among the pieces of evidence Callahan said Hulshof kept from Kezer's attorneys were:

-- Investigative notebooks from Scott County deputy Brenda Schiwitz. The notes included information on other possible suspects as well as a statement from a prosecution witness that contradicted another witness' statement placing Kezer at the crime scene.

Schiwitz testified in a 1993 pretrial deposition that she destroyed her notes. In fact, they were later found in the case file by Walter, the new sheriff. Schiwitz testified in the new appeal that she gave those notes to Hulshof and Van Godsey, his chief investigator.

-- A Scott City police interview of another suspect that also contradicted the witness' identification of Kezer being seen near Lawless' car. The person named in that interview was biracial; Kezer is white.

-- a written statement by a Cape Girardeau jail inmate who admitted lying that Kezer had confessed to the killing. The inmate said he lied in hopes of getting a reduced sentence on his own pending charges.

Two other inmates seeking reduced sentences also claimed that Kezer confessed. But when defense attorney David Rosener introduced signed statements by the three inmates recanting their earlier claims, Hulshof succeeded in keeping those admissions from being introduced at trial by suggesting that Rosener threatened the men to obtain their statements.

An AP investigation found that in four cases -- excluding the latest Kezer decision -- prosecutorial errors by Hulshof led to death sentence reversals.

Another accused murderer won acquittal by a new jury at a second trial after his Hulshof-prosecuted conviction was rejected on appeal. A seventh defendant sentenced to life in prison without parole briefly won his freedom when a federal judge tossed out the conviction, although it was later restored.

Hulshof's errors cited by appeals courts often occurred during closing arguments or in a trial's penalty phase. Judges said that Hulshof too readily embellished arguments with his own opinions, or with facts outside the court record.

Callahan, the Cole County judge, faulted Hulshof for similar misconduct during closing arguments at the Kezer trial.

"We put him at the scene, we put a gun in his hand, we put the victim with him, we have got blood on his clothes," Hulshof told the jury.

Callahan said that "none of what Mr. Hulshof said in that final summary was true. ... Testimony putting (Kezer) at the scene is totally discredited. No gun was ever found, and there is no credible evidence that he ever had a gun.

The judge added that new evidence uncovered since the first trial -- including an ex-boyfriend's DNA found under Lawless' fingernails -- further suggests that Kezer was wrongly imprisoned.

Charlie Weiss, Kezer's appellate attorney, called Callahan's ruling "a blockbuster," noting Callahan's background as a prosecutor. Callahan spent three decades in the Cole County prosecutor's office before becoming a judge in 2002.

Weiss said he hopes the ruling sends a clear message to that Kezer, now 34, deserves to be set free after spending half his life behind bars.

"When you read this opinion, there is just no evidence against Joshua Kezer at all," he said "I just can't see how a prosecution could proceed in good faith."

This was a long time coming, and I also think it is the correct decision, and thank you Bridget for keeping this story in the public eye.

Now I think it is most important that the correct person be put on trial for this murder, and that any wrong doing by any law enforcement people should also be looked into.

congratulations MR KEZER as a scott county resident i apologize that is has taken this long for your freedom to be given back to you. now i hope that for the lawless famly the RIGHT person is put behind bars for this crime

I've always thought this man was innocent. I hope his release is a speedy one and I pray he is able to get on with his life. He has lost much, and has endured way more than imagineable, so...

if taken to poll, who do you think should have to pay restitution to Joshua? My vote would be for the accuser himself! Wow! Liberty and Justice prevailed! Well done Judge!

I'm so happy for him! I recently moved to Scott County and became familar with this case. The justice system let down so many people, not only the Kezer family and the Lawless family as well. Just think their is a killer still walking around out there. For the Lawless family I pray that they get the justice they deserve and end their pain. Hopefully Angela can rest in peace very soon!! And for the Kezer family I'm praying for you as well.

Of course it is a pipedream that Mr. Hulshof spend the rest of Josh's term in his cell, which would begin to approach true justice. May we ask that the Missouri Bar begin earnest proceedings to investigate the permanent disbarment of this attorney who has, we now know, used his considerable skills to pervert our state's system of justice?

We cannot say it was only at the expense of a few easy-to- railroad people like Josh and his family. Make no mistake; Hulshof has exposed and endangered us all--the next prosecutor will decide YOU are unworthy of the protection of our system, that you would be a convenient pawn in the advancement of a career.

Disbar Kenny Hulshof now.

As I said after the Welty acquittal, prosecutors can't be trusted. This is exactly why the death penalty can't be allowed. Not because a guilty murderer doesn't deserve it, but because prosecutors cannot be trusted to charge and convict the right person. And they certainly can't be trusted to EVER hold their hands up and admit they got the wrong person. There are a heck of a lot of innocent people sitting on death row across the country right now. And again there is probably a murderer still running around loose out there somewhere. Swingle is still using the Cape County website to sell his books, using our tax money for his own personal gain. I hope Kezer sues the pants off Hulshof and the cops who ran a crooked investigation.

Three Cheers for Rick Walters and the Scott county sheriffs office. Now let's finish this mess by putting some guilty people in jail not only the killer, but the lawmen that helped keep justice from happening.

Josh good luck in your future you have a lot of people pulling for you don't let them down.

This is why people lose faith in our justice system. Yes, I guess you could say that it actually worked since an innocent man was exonerated, but who is going to make it up to that man for the horrors he has endured. And what are we to think of Kenny Hulshoff? Thank God he isn't our governor. How any person sworn to uphold the law could so callously disregard it's core principles is beyond me.

The Missourian was given accurate investigatorial information ten years ago--the same info with which Rick Walters and Kezer's attorneys started. The paper refused, saying they preferred avoiding the local controversy. Bridget diCosmo was a godsend with guts.

Does the editorial staff have the intestinal fortitude to begin calling for Kenny Hulshof's disbarment? How can we stand by and ignore the now obvious effort of a public official to rob a young man of the sixteen prime years of his life, and for what? Mr. Hulshof has evidentally laid waste to Missouri criminal prosecution. It would be noble and courageous on the part of the Missourian.

We all knew that Joshua did not do this terrible thing.

It is about time that this action has been taken, and Josh will finally get out of that hell hole. He has lost half his life there. Now he is gonna have to learn how to live on the out-side. Joshua has a long road ahead of him, but alot of people that love him also. Thank-God for all the people that stood by him, because they knew he was innocent!!!! Be strong Lawless family, they will get the right person, and I am praying for all of you.

Praise the LORD!! My son is coming home!! Yes, I am josh's mother, & hee my only child. I felt I'd lost everything when he was STOLEN by the "injustice" system. They tried to destroy us, but we are a family of faith & where there is faith there is hope. I've always felt badly for the Lawless family because they were denied justice & now, even if the real people are tried, they may never believe the truth.

Kudos to you, Bridget, for being brave enough to keep this alive. Shame on you KFVS 12. Your public has a right to the news as it is.

As for Kenny H., Bill F., Brenda S & all who lied for their own personal gain...well, you have someone to answer to than Josh or me--He is the King of Justice.

It isn't home free for Kezer just yet. Scott county still has to do the right thing.

I am constantly amazed at how many people think we have a justice system. We don't, we have a legal system. Any similarity between law and justice is purely coincidental.

The people who belong in Josh's cell is "Sheriff Bill and Kenny.I know it won't happen but its a thought shared by many.

What scares me is if Kenny won the election,would Josh be set free? It scares me to think that he would not be.

Wasn't Kenny working under Attorney General JAY NIXON at the time?

PS: I'm glad he's free. I agree with the post that we don't have a justice system, but a legal system. My brother was killed by his wife several years ago & this is easily apparent to anyone who knew them & several witnesses who gave false police reports. She's free, he's 6 feet under. There is no justice in this world, but there will be in the next.

I think the depuity that lied about her notes being distroyed needs to be brought up on charges along with all the others that lied under oath. After all thats a crime isn't it! If not I guess any one should be able to do it without punishment !!!!!!!!!

There has been no mention of Joshua's Attorney, Mr Charlie Weiss who I believe worked this case at no charge. He was brilliant and sought justice. To my knowledge his expertise in law is not as a defense attorney. God Bless Charlie for his hard work. Best wishes to Josh and his family. Also our prayers are with the Lawless family to get closure by finding the guilty party.

Search for inmate # 508903... click on "Photos"... Then click on an earlier picture.

In 2004, he looked like a rat... But then again, he was in prison.

This is wonderful news - and so heartbreaking at the same time. I can't imagine the emotional toll Joshua & his mother & family have experienced for the last 15 years. I can't imagine how the Lawless family is holding up after this news. What Kenny Hulshof & those involved who suppressed evidence did is absolutely cowardly & reeks of super ego maniacs gone wild! To think that Hulshof could be governor now & be able to keep Joshua in prison to cover his & all the others backsides makes me sick! I think an investigation needs to be opened immediately & those TRULY guilty be punished. I will never forget Hulshof in one of his ads while running for governor acting like the perfect "good ole boy" showing his daughters how to measure the correct way. What a crock of $7*)!! Many prayers to the Keezer & Lawless families. I am so sorry for your pain!

One wonders why thus far the MO bar association and the judicial system have not reviewed Hulshof's past convictions to see whether thay also have been....convienently altered, to suit his record of exemplary convictions. Perhaps the members of the bar should investigate Hulshof and *ALL* of his activity in the court to see whether other cases need to be revaluated for consistancy and integrity. This man sounds like he just wants someone to go to prison and he doesn't care who it is.

"Damn the law man. Convict, convict, CONVICT!!!!"
