It appears that the API actually wanted the EPA to reduce the advanced biofuels goal by the 8 million gallons of cellulosic product that was not available. In this the API failed.

Furthermore, it was not a matter of anything being "illegal."

"Still, the court rejected API's challenge to the government's decision not to lower its goal for use of advanced biofuels in general.

The court agreed with EPA's finding that other advanced biofuels, including imported sugarcane ethanol and biomass-based diesel, could make up for the shortfall in Congress' goal of 500 million gallons of cellulosic ethanol use in 2012."

Let's put the real blame on the creator of that out of control EPA. That liberl lion Richard M Nixon. There is not a former republican president who today would meet the demands of the republicans.

The Progressive push toward fascism never ceases. It does not matter whether the president and Congress is Democrat or Republican.

Mussolini made the claim that fascism is the next step after socialism. He was a socialist before he became a fascist. He was a fan of OTTO Von Bismark's welfare state. He just added the corporate state.

FD Roosevelt was a big fan of Mussolini's fascism. It seems that every president after FDR were/are fans of Mussolini's fascism.

The most aggressive pushers toward fascism, after FDR, by rank in my opinion have been 1. George W. Bush, 2. Nixon, 3. Obama, 4. Johnson, 5. George H. Bush, 6. Carter, 7. Truman, 8. Clinton, 9. Ford, 10. Kennedy, 11. Eisenhower, 12. Reagan.

This push toward fascism was hidden by political theatrics.

Republicans since the 1960's, with the possible exception of Reagan, have bowed to neoconservatism, or what is generally called media conservatism. Leo Strauss would have been pleased. Neoconservatism is a push toward fascism.

Democrats have always claimed, and truly are progressives. That progression has always been toward fascism.
