It was a pleasure to be invited by Rich Payne (Cape Girardeau Career & Technology Center) to address the members of MCCTA. Topics covered: Current legislation pertaining to Career and Technical Education (HB 1612, SB 620 and SB 582), proposed changes to school foundation formula (HB 1943), reauthorization of federal education act (ESSA), and the Blueprint for Higher Education (http://dhe.mo.gov/blueprint.php). www.mccta.org
SUMMARY OF HOUSE ACTION – THIRD READ & PASSED
HCR 63 - Urges Congress to reject and revoke President Obama's Executive Order on firearm control
HB 1568 - Allows physicians to prescribe naloxone to any individual to administer, in good faith, to another individual suffering from an opiate-induced drug overdose
HB 1681 - Exempts yoga training courses, programs, or schools from provisions of law regulating proprietary schools
HB 1795 - Requires the Department of Social Services to contract with a third party to verify eligibility data for public assistance programs - By January 1, 2017, this bill requires the Department of Social
Services to procure and enter into a competitively bid contract with a contractor for the purpose of providing verification of initial and ongoing eligibility data for assistance under the Supplemental Nutrition Assistance Program; Temporary Assistance for Needy Families; Women, Infants, and Children Supplemental Nutrition Program; Child Care Assistance Program; and MO HealthNet Program.
The contractor must conduct data matches using specified information relevant to eligibility against public records and other data sources to verify eligibility data. The contractor must evaluate the income, resources, and assets of each applicant and recipient no less than quarterly. In addition to quarterly
eligibility data verification, the contractor must identify on a monthly basis any program participants who have died, moved out of state, or have been incarcerated longer than 90 days.
HB 1837 - Prohibits two-way telecommunications devices and their component parts in correctional centers and jails. - Under current law, it is a crime to possess, deliver, deposit, or conceal certain items in a prison or jail. This act adds two-way telecommunications devices and their component parts to the list of prohibited items.
HB 1862 - Modifies provisions relating to landlord-tenant law. -This bill specifies that for the purpose of restoring possession in a landlord tenant action, judgment must be executed no sooner than
10 days after the judgment. This bill specifies that a landlord and tenant may agree in the rental agreement to withhold from the security deposit an amount or fee for specific services that may be required to return the rental premises to its condition at the commencement of the tenancy.
Currently, a landlord is authorized to withhold only the amount that is reasonably necessary to restore the dwelling unit to its condition at the commencement of the tenancy, ordinary wear and tear excepted.
HB 2140 - Changes the laws regarding sales tax on automobiles and establishes the "Missouri Task Force on Fair, Nondiscriminatory Local Taxation Concerning Motor Vehicles, Trailers, Boats, and Outboard Motors." - This bill authorizes a taxing jurisdiction to hold a vote, no later than November 2019, on whether to impose a local sales tax on vehicle titling on purchases from a source other than a licensed
Missouri dealer after such a tax was repealed. The bill creates the Missouri Task Force on Fair, Nondiscriminatory Local Taxation Concerning Motor Vehicles, Trailers, Boats, and Outboard Motors. The task force will review the disparity in taxation that resulted from the Missouri Supreme Court's decision in Street v. Director of Revenue, the need for local jurisdictions to continue to receive revenue to provide vital services, and the need to avoid placing Missouri dealers of motor vehicles at a competitive disadvantage to non-Missouri dealers. The task force must submit a report of its findings to the Governor and General Assembly by December 31, 2018 and the task force expires on January 1, 2019.
